How the FUCK do you prove #2 in a court of law?
Shockingly many of them have made public statements saying they believe this technology will destroy humanity… so using their own testimony, I suppose?
Proof, lawsuit etc would come later. If it is proven to be not dangerous, then they can be free. They would have to admit to hyperbole.
If someone shouted “I have a bomb!!!” in a crowded place, they would be apprehended immediately. This is similar.
